Dave Lampell delivers a short program documenting the shootout in New Orleans in 1974 where Mark Essex, a 23 year old Vietnam veteran killed police officers. The area was closed off, and calling on backup for reinforcements, police numbers were in the hundreds. They believed there to be more than one sniper. They shot Mark Essex over one hundred times, killing him the first night of the shootout. The police also took out many of their own in an insane display of force. The rest of the program gives a history of Mark Essex’s life in Kansas and suffering racism in the military. Great quotes about the racist State from his mother and sister.

An open letter to Judge John Murtaugh by Michael Cetewayo Tabor in response to Murtaugh’s request of the Panther 21 to obey his rules and keep complete silence during their trail in his courtroom. This manifesto response, spoken in the courtroom, gives a history of America since colonialism until present day 1970 through the African-American experience. Topics mentioned are: colonialism, slavery, the constitution, Amendments 13,14,15, the Reconstruction Era, Plessy v. Ferguson, Brown v. Board, public segregation, COINTELPRO. Key people mentioned: NYC District Attorney Frank Hogan, Judge Charles Marks, Black Panthers Joan Mury and Lee Barry. Manifesto ends with each Panther 21 stating their name.

This is the first "Nothing Is More Precious Than" (Freedom and Independence) program. Begins with a report from the Union of Vietnamese, commentary on political prisoners. States that under the Thieu regime, huge numbers of people in concentration camps and prisons—more prisons have been built than schools and churches combined. The Union demands that all political prisoners be released, all US aid cut off, and implementation of the agreement take place. Update on Chile, actions against the fascist coup, reports on bomb explosions at ITT and ATT. Weather Underground communiqué read in full.
