<p>Miami, August 20.- The defense team for Gerardo Hernandez, one
of the five Cuban anti-terrorists sentenced to long prison terms in the
United States, filed an appeal today in Miami to overturn his
conviction. <br>
<br>
Attorney Martin Garbus introduced the 82-page affidavit in the U.S.
District Court in Miami, to support the habeas corpus appeal for
Gerardo and the reversal of his conviction, citing misconduct by the
U.S. Government during the trial.<br>
<br>
Gerardo, sentenced to double life plus 15 years, was detained in
September 1998 along with Rene Gonzalez, Ramon Labañino, Antonio
Guerrero and Fernando Gonzalez, for monitoring violent groups in Miami
that were organizing and carrying out actions against the island.<br>
<br>
Through the affidavit, the defense team asks the court, on behalf of
Gerardo, to order discovery from Washington of evidence that reveals
payments to journalists to create a hostile atmosphere and influence

<big>HAVANA, Cuba, Aug 18 (ACN) Gerardo Hernandez Nordelo, one of the
five anti-terrorists held in the US since 1998, said that justice will
not come along by itself regarding their case, because it takes
permanent struggle against the media campaign on Cuba, as a crucial
factor.</big><font color="#003578"><font size="4"><br>

</font></font></span></font>The case of the Cuban Five is now at an
important moment, said Hernandez in a message sent on behalf of the
five heroes held in the U.S. which was read by his wife Adriana Perez
at the 13th Peruvian National Forum in Solidarity with Cuba, underway
in the city of Chiclayo.<br>

Hernandez, who was given two life terms plus 15 years in the U.S., said
that he has progressively been closed all his legal ways, though US
authorities now have a new chance to make justice, as he referred to an
affidavit to be filed with the Miami Federal District Court on Monday
by his defense attorney, PL news agency reported.<br>

“Our defense team will present new documents to denounce the public
opinion manipulation carried out prior, during and after the trial by
the US government, which said to have guaranteed a fair process for the
Five, reads the message.<br>
<br>
It has been proven that the Miami journalists who wrote defamatory
articles against the five Cubans were paid by the US government, while
the prosecution never informed the defense about it, as it is
stipulated by the law.<br>
<br>
But despite this fact, the prosecution opposes the release of the
contracts signed by the government and the journalists, or that they
are summoned by the court, the message explains.<br>
Gerardo also appreciated the expressions of solidarity with the Five at
the Chiclayo forum and stressed the importance of such support.<br>
<br>
Hundreds of participants at the meeting listened to Adriana Perez, who
affirmed that justice in the case of the Cuban Five will be achieved
through solidarity actions.<br>
<br>
Perez will also visit Bolivia August 22-26, where she will meet with
local journalists and media directors, and with professionals. </div>
