Vista Judicial para Suprimir Citaciones al Gran Jurado<br>

Este viernes, 27 de junio de 2008, el Lcdo. Martin Stolar y la Lcda.
Susan Tipograph, presentarán una moción en la corte de la Ciudad de Nueva
York para que se supriman las citaciones de un Gran Jurado a dos jóvenes
independentistas. Los licenciados Stolar y Tipograph, del Gremio
Nacional de Abogados, representan a Tania Frontera y a Christopher
Torres, cuyas citaciones para comparecer ante un Gran Jurado federal en
Nueva York han sido pospuestas por la fiscalía federal en más de una
ocasión. <br>
<br>
La moción llamada "Motion to quash grand jury subpoenas" se
presentará en la sala del "Eastern District Court of New York"
alegando que:<br>
<br>
1. El FBI debe declarar si las citaciones y los interrogatorios del gran
jurado son producto de intervenciones electrónicas ilegales.<br>
<br>
2. El Gran Jurado es un mecanismo secreto que no permite la presencia de
la prensa y la comunidad ni la debida representación legal, pues tampoco
permite al abogado estar presente durante el interrogatorio.<br>
<br>
3. El Gran Jurado ha sido utilizado contra el movimiento independentista
en Puerto Rico y en los EEUU con fines de represión política desde
los años 30, cuando se le solicitaron al Partido Nacionalista sus listas
de miembros, y ha sido utilizado como instrumento de la fiscalía federal
para perseguir activistas políticos.<br>

4. La ley estadounidense exige que el Gran Jurado debe respetar la
libertad de asociación garantizada bajo la primera enmienda,
especialmente cuando hay una historia de hostigamiento como existe contra
el movimiento independentista. Las citaciones a estos jóvenes
independentistas violan su libertad de asociación.<br>

Los jóvenes independentistas citados están conscientes de cómo el
Gobierno de EEUU ha reprimido el movimiento independentista por medio del
Gran Jurado, la vigilancia policiaca y hasta medidas extralegales tales
como la ejecución de líderes independentistas.<br>
<br>
Las legisladoras de la Ciudad de Nueva York, Melissa Mark Viverito,
Leticia James y Rosie Méndez condenaron públicamente la persecución del
FBI contra los activistas, el miércoles 25 de junio de 2008 en la
Alcaldía de la Ciudad de NY. Los legisladores, amigos y familiares
se solidarizaron con los independentistas citados al Gran Jurado.

En Nueva York, la organización "Hostos One Eleven Grand Jury
Resistance Coalition" realizará una manifestación de apoyo a los
citados al gran jurado este viernes, 27 de junio de 2008 a la 1:30 PM
mientras se presenta la moción en la corte.<br>
<br>
En San Juan, organizaciones independentistas, socialistas y por la
defensa de los derechos humanos esperarán por el resultado de la vista
para anunciar sus actividades de apoyo a los independentistas
citados.<br>
<br>
La Mesa de Solidaridad en Puerto Rico reafirma su llamado a la NO
COLABORACIÓN con el gran jurado y el FBI. ¡Ante la represión, unidad y

Judicial Hearing on Motion to Quash Grand Jury Subpoenas<br>

This Friday, June 27, 2008, attorneys Martin Stolar and Susan Tipograph
will present a motion in court in New York City to quash the Grand Jury
subpoenas of two young independentistas. Attorneys Stolar and Tipograph,
of the National Lawyers Guild, represent Tania Frontera and Christopher
Torres, whose subpoenas to appear before a federal Grand Jury in New York
had been postponed by the federal prosecutor on more than one
occasion.<br>
<br>
The motion, called Motion to Quash Grand Jury Subpoenas, will be
presented in court in the U.S. Court for the Eastern District of New
York, asserting that:<br>
<br>
1. The FBI should state whether the subpoenas or grand jury questions are
the product of illegal electronic interventions.<br>
<br>
2. The Grand Jury is a secret mechanism where the press and the community
are not permitted, and there is no proper legal representation, given
that the attorney is also not permitted to be present during
questioning.<br>
<br>
3. The Grand Jury has been used against the independence movement in
Puerto Rico and the United States for the purpose of political repression
since the 1930's, when the grand jury subpoenaed the Nationalist Party
for its membership list, and the federal prosecution has used it as a
tool to persecute political activists.<br>
<br>
4. U.S. law requires the Grand Jury to respect the freedom of association
guaranteed by the First Amendment, especially in the face of the history
of harassment that exists against the independence movement. The
subpoenas of these young independentistas violates their freedom of
association.<br>
<br>
The young subpoenaed independentistas are conscious of how the U.S.
government has repressed the independence movement using the Grand Jury,
police surveillance and even extralegal measures such as the execution of
independentista leaders.<br>
<br>
On Wednesday June 25, at New York City Hall, New York City legislators
Melissa Mark Viverito, Leticia James and Rosie Méndez publicly condemned
the FBI’s persecution of the activists. The legislators, friends and
family members came together in support of the independentistas
subpoenaed to the Grand Jury.<br>
<br>
In New York, on Friday June 27 at 1:30 p.m., the organization Hostos One
Eleven Grand Jury Resistance Coalition will convene a demonstration of
support while the motion is presented in court.<br>
<br>
In San Juan, independentista, human rights and socialist organizations
will wait for the results of the hearing to announce their activities in
support of the subpoenaed independentistas.<br>
<br>
The Table of Solidarity in Puerto Rico reaffirms its call for NON
COLLABORATION with the grand jury and the FBI. In the face of repression,
unity and struggle!<br>
