PIP condena al Departamento de Justicia por no encausar al FBI<br>

San Juan, Puerto Rico - El Partido Independentista Puertorriqueño (PIP)
reaccionó hoy por voz de su secretario general, Lcdo. Juan Dalmau
Ramírez, al anuncio del Departamento de Justicia de Puerto Rico del
archivo y cierre del caso del asesinato de Filiberto Ojeda Ríos por el
FBI. Dalmau Ramírez se expresó así: <br>
<br>
"El Secretario de Justicia renunció a su responsabilidad de defender
los intereses del pueblo puertorriqueño y se convirtió en el abogado de
defensa del FBI y Luis Fraticelli ante los señalamientos criminales
contra éstos por el asesinato de Filiberto Ojeda Ríos. Todo esto con la
anuencia y el consentimiento del gobernador Aníbal Acevedo Vilá. <br>
<br>
Del propio informe del Departamento de Justicia surge evidencia
incontrovertible de hechos que señalan los actos criminales del FBI. No
obstante, la administración de Acevedo Vilá decidió dar por terminada la
investigación y no radicar acusaciones contra los responsables del
asesinato de Filiberto Ojeda. <br>
<br>
En primer lugar, es un hecho incontrovertible que el agente del FBI que
asesinó a Filiberto Ojeda no disparó en defensa propia, contrario a lo
que había señalado ante el Inspector General del Departamento de Justicia
federal. Como cuestión de hecho, el propio informe del Departamento de
Justicia de Puerto Rico señala que "el agente "Bryan" (un
pseudónimo) cuando realizó los disparos que ocasionaron la muerte de
Filiberto Ojeda Ríos, denotan un intencionado y deliberado curso de
acción." <br>
<br>
Habiéndose probado científicamente por parte del Instituto de Ciencias
Forenses de Puerto Rico que los disparos del agente del FBI contra
Filiberto no fueron en defensa propia y que sus actos fueron
intencionados y deliberados, no queda otra conclusión de que esto se
trató de un asesinato. Ante esta evidencia la administración de Acevedo
Vilá prefirió no radicar acusaciones. <br>
<br>
En segundo lugar, queda demostrado por el propio informe que no era
cierta la teoría de que el uso excesivo de fuerza y armamento era
necesario para crear un elemento sorpresa y arrestar a Filiberto Ojeda.
De la propia información que ofrece el FBI al Inspector General del
Departamento de Justicia federal y la información recopilada por el
Departamento de Justicia de Puerto Rico surge que horas antes de que se
ejecutara el operativo, el FBI se encontraba a cerca de 300 metros de la
entrada de la finca donde se hallaba Filiberto Ojeda. Había clausurado
las carreteras con agentes identificados con las siglas del FBI en su
vestimenta, lo que daba publicidad a su presencia. Incluso, permitieron
la entrada del dueño de la propiedad donde se encontraba Filiberto Ojeda,
a quien el FBI ha señalado como un colaborador de Filiberto Ojeda. Por lo
tanto, lejos de actuar con urgencia para crear un elemento sorpresa, el
FBI creó las condiciones para que Filiberto Ojeda fuese avisado y tuviera
conocimiento del operativo y generar así una confrontación que les
justificar el asesinato que desde un principio habían planificado
perpetrar. <br>
<br>
En tercer lugar, el Departamento de Justicia recoge la información del
Inspector General del Departamento de Justicia federal en cuanto a que
una vez el agente "Bryan" dispara contra Filiberto Ojeda
escucha su quejido. Escucha cuando cae al suelo e incluso agentes
escuchan sonidos que dan la impresión de que se está ahogando. Sin
embargo, lo dejaron tirado en el suelo, desangrándose, sin entrar a la
residencia para evitar su muerte. Ante esto el Secretario de Justicia
plantea que como de todas formas iba a morir no hay responsabilidad que
fijarle a los agentes federales. <br>
<br>
Estos tres hechos son incontrovertibles y sin embargo, en cada uno de
ello, que denotan conducta criminal de parte del FBI, el Departamento de
Justicia presenta defensas o justificaciones que podría levantar el FBI
para haber actuado como actuó y de esa manera lavarse las manos y no
radicar las acusaciones contra el FBI en Puerto Rico, contra Luis
Fraticelli y los agentes que participaron de este operativo. <br>
<br>
Nuevamente, el liderato del Partido Popular y sus funcionarios de
gobierno manipularon las sensibilidades de nuestro pueblo,
particularmente sectores del independentismo, para crear la falsa
impresión de que el gobierno se dirigía a tomar acciones contundentes
ante el asesinato de Filiberto Ojeda. Teniendo la evidencia, teniendo la
información, y señalando a los participantes en un evento que se puede
catalogar como criminal, se lavan las manos, y justifican no actuar tras
tecnicismos legales. <br>
<br>
Lo que hubiese constituido una respuesta digna de parte del gobierno
hubiese sido radicar las acusaciones correspondientes contra el Jefe del
FBI y contra los agentes que participaron".<br>

San Juan, Puerto Rico - The Puerto Rican Independence Party (PIP) reacted
today through its secretary general, attorney Juan Dalmau Ramírez, to the
announcement of the Department of Justice of Puerto Rico that it was
dismissing and closing the case of the FBI’s assassination of Filiberto
Ojeda Ríos. Dalmau Ramírez expressed the following:<br>

“The Attorney General abandoned his responsibility to defend the
interests of the Puerto Rican people and became the defense attorney for
the FBI and Luis Fraticelli in the face of criminal charges for the
assassination of Filiberto Ojeda Ríos, all with the ratification and
consent of governor Aníbal Acevedo Vilá. <br>
<br>
The Department of Justice’s own report documents indisputable evidence of
facts that indicate criminal acts by the FBI. However, Acevedo Vilá’s
administration decided to close the investigation and not charge those
responsible for the assassination of Filiberto Ojeda.<br>
<br>
In the first place, it is an indisputable fact that the FBI agent who
assassinated Filiberto Ojeda did not shoot in self defense, contrary to
what he told the Inspector General of the federal Department of Justice.
As an issue of fact, the Puerto Rico Department of Justice’s own report
indicates that “when agent ‘Bryan’ (a pseudonym) fired the shots that
caused the death of Filiberto Ojeda Ríos, they denote an intentional and
deliberate course of action.”<br>
<br>
Once the Institute of Forensic Sciences scientifically proved that the
FBI agent’s shooting of Filiberto was not in self defense and that his
conduct was intentional and deliberate, the only conclusion is that we
are talking about an assassination. In the face of this evidence, the
Acevedo Vilá administration preferred not to prosecute.<br>
<br>
Second, the report gives the lie to the theory that the excessive use of
force and weapons was necessary to create an element of surprise and to
arrest Filiberto Ojeda. The very information offered by the FBI to the
Inspector General of the federal Department of Justice and the
information complied by the Puerto Rico Department of Justice reveals
that hours before the execution of the operation, the FBI was about 300
meters from the entrance to the farm where Filiberto Ojeda was found.
They had blockaded the highways with agents identified with FBI initials
on their clothing, which publicized their presence. However, they allowed
the owner of the property where Filiberto Ojeda was– who the FBI
identified as one of his collaborators– to enter. Thus, far from acting
with urgency to create an element of surprise, the FBI created the
conditions so that Filiberto Ojeda would be notified and aware of the
operation, and thus generate a confrontation which would justify their
assassinating him, which they had planned to do from the beginning.<br>
<br>
Third, the Department of Justice used information from the Inspector
General of the federal Department of Justice that agent “Bryan” heard
Filiberto Ojeda moaning after he shot him. He heard when he fell to the
ground, and agents heard sounds that gave the impression that he was
drowning. Nevertheless, they left him spread on the floor, bleeding to
death, without entering the residence to prevent his death. In the face
of this evidence, the Attorney General posits that because he was going
to die anyway, there is no point in holding the federal agents
responsible.<br>
<br>
These three facts are indisputable, and nevertheless, for each one which
denotes criminal conduct on the part of the FBI, the Department of
Justice presents defenses or justifications that the FBI could raise in
order to have acted as they did, and thus wash their hands and not
prosecute the FBI in Puerto Rico, neither Luis Fraticelli nor the agents
who participated in the operation.<br>
<br>
Once again, the leadership of the Popular Party and its government
functionaries manipulated the sensibilities of our people, particularly
independentist sectors, to create the false impression that the
government would take offensive action in the face of the assassination
of Filiberto Ojeda. Having the evidence and information involving
participants of an event that could be called criminal, they wash their
hands and justify their failure to act using legal technicalities.<br>
<br>
A dignified response on the part of the government would have been to
make appropriate charges against the Head of the FBI and the agents who
participated.”<br><br>
