filed an appeal to the United States Court of Appeals for the Tenth

Circuit.<br>

This appeal concerns the unconstitutional application of Section 235(

b)(3)<br>

of the SRA by the Parole Commission. This enactment made substantial

changes<br>

by stripping the Parole Commission of any discretion and by establishing

a<br>

method of determinate sentencing. <br><br>
