</a>Dear Friends and Supporters;<br><br>
As you know I will be going to the parole board for the third time in
early July, 2006 seeking release considerations after completion of 34
years of imprisonment. I was denied release in July 2002 and 2004 due to
the nature of the crime and criminal history. These denials did not take
into account the fact that I had an exemplary prison record due to the
fact that the New York State parole guidelines have no provisions for
release because of good behavior and performances of assignments. Parole
release is based solely on the discretion of the parole commissioner's
void of any specific criteria requiring my release.<br><br>
In other words, despite over three decades of imprisonment and no
egregious rule violations, the parole board has the discretion to deny my
release on parole. What is particularly ominous is the fact Governor
Pataki has instituted an unwritten mandate that those convicted of felony
offense[s] must complete 85% of their sentence to be eligible for
release. This mandate adheres to the federal "Truth in
Sentencing" laws and a federal program that has provided NYS over
$200 million to keep those convicted of violent felonies in prison for
longer periods of time. <br><br>
Due to the political nature of my conviction, NYS parole authorities are
hard to persuade I am a suitable candidate for parole. Previously, the
PBA has lobbied against my release by submitting a petition of 10,000
signatures opposing it. Therefore, it is incumbent for my friends and
supporters to write letters highlighting my achievements.<br><br>
Importantly, all letters written in support of my release should be sent
no later then the second week of July, and a copy sent to my attorney:

ADDENDUM:<br><br>
Here is a list of officials who should be written to and urged to support
my efforts to be released on parole. I am confident after your reading of
the enclosed, you'll understand the difficulties of gaining parole,
despite having done everything necessary to be granted parole. Here, I am
confronted with the politics of parole, and only the power of the people
will ensure we prevail and win my release. I am enclosing a SAMPLE LETTER
to be sent to the elected officials. Please use this or expand on the
issue according to you own understanding of the issue.<br><br>
Furthermore, I ask that copies be made of this material and for this to
be distributed across the country and on the internet. As many New
Yorkers know, Governor Pataki has aspirations to run for the office of
President in 2008. I am of the opinion it is important that progressive
people know and understand how Governor Pataki has subverted NYS
legislators in this and other matters. We can expect he would seek to do
the same towards the Congress and House of Representatives if he were to
win the White House.<br><br>
