We have received notification that the hearing scheduled on behalf of
<br>
Mumia for February 11, has been canceled. A copy of the order is <br>
attached.<br><br>
Judge Pamela Dembe, Court of Common Pleas, Philadelphia, has ordered
<br>
briefing by February 15 on the issue of whether the Pennsylvania <br>
Supreme Court's recent decision in Commonwealth v. Johnson, 2004 Pa.
<br>
LEXIS 3118, "speaks to the jurisdiction of the Court to proceed in
<br>
defendant's third PCRA petition." This is disturbing since the
court's <br>
preliminary interpretation of the Johnson case appears to be wrong, for
<br>
it does not prevent her from granting us a hearing on two issues of
<br>
great significance relating to the unfairness of the trial. There is
<br>
no new law in Johnson, rather it is just the application of <br>
long-established law to the facts of Mumia's case.<br><br>
You will be advised as there are more developments on this & other
<br>
aspects of the case.<br><br>
