Mistrial declared in RNC Molotov case

A mistrial was declared today when jurors could 
not reach a verdict in the trial of Republican 
National Convention protester David McKay.

Jurors told U.S. District Court Judge Michael 
Davis they were "hopelessly deadlocked." McKay 
will stand trial again March 16.

McKay, a 22-year-old from Austin, Texas, was 
accused of making Molotov cocktails to be thrown 
during the convention in St. Paul last September.

Another Austin man, 23-year-old Bradley Crowder, 
pleaded guilty in early January to the same charge.

McKay testified last week that he was enticed 
into making the incendiary devices by Brandon 
Darby, who was working undercover as an FBI 
informant. Darby, testifying for the prosecution, 
said he tried to talk McKay out of using them.

Davis said he will release McKay on a $25,000 
bond and allow him to return to Texas while 
awaiting his second trial. He has been in jail since his arrest in September.
