El ex director del Instituto de Ciencias Forenses 
(ICF), Pío Rechany, aseguró ayer que agentes del 
Negociado Federal de Investigaciones (FBI) 
dispararon a Filiberto Ojeda Ríos con la 
intención de matar al dirigente independentista.

“Estaban usando fuerza de más para ver si lo 
mataban a través de la puerta”, dijo Rechany 
durante el primer día de las vistas públicas de 
la Comisión de Derechos Civiles (CDC), en las que 
se investiga la muerte de Ojeda Ríos.

Rechany, quien estuvo al frente del ICF por 13 
años, aludía a tres disparos en el techo de la 
casa de Ojeda Ríos que cruzaron una puerta de 
madera que nunca fue abierta. Dijo que se trataba 
de una violación al “manual de uso de fuerza 
mortal” del FBI, porque no era en defensa propia.

El FBI ha negado que haya actuado de forma ilegal 
en la muerte de Ojeda Ríos. El informe de la 
Oficina del Inspector General (OIG), otro organismo federal, los exonera.

Rechany comentó que durante la pesquisa de la OIG 
tuvo que aclararle varias cosas a la agencia. La 
primera fue lo de los disparos en el techo. La 
segunda que había dos balas que no concordaban 
con las armas que el FBI entregó como usadas en 
la balacera. La OIG dijo al principio que era un 
error del ICF, pero un agente federal 
posteriormente entregó el arma de la cual 
salieron los disparos y dijo que no lo hizo antes 
porque no recordó haberla usado.

Dice que “Brian” mintió

El ex jefe de ICF criticó las conclusiones de la 
OIG. “Los agentes negaron los impactos en la 
puerta, negaron los dos casquillos
 debieron 
restarle toda credibilidad
 (Luis) Fraticelli 
llegó a decir que perdió control de la escena. 
¿Cómo tú puedes concluir que todo está bien?”, cuestionó Rechany.

También especuló que “Brian”, el agente del 
disparo fatal, mintió cuando dijo que vio a Ojeda 
Ríos al momento de disparar por la luz de la 
nevera. Indicó que en internet uno puede ver que 
rifles como los del FBI vienen con tecnologías de 
luces infrarrojas o detectores de calor que les 
permitirían saber exactamente dónde disparar. 
Rechany también cree que “Brian” siguió una orden 
directa de disparar a matar a Ojeda Ríos.

Rechany cree que se pudo capturar a Ojeda Ríos 
sin fuerza letal -en la escena se ocuparon 107 
casquillos de los rifles del FBI y 19 de la 
pistola de Ojeda Ríos- el 23 de septiembre de 2005 en Hormigueros.

“El operativo estuvo mal”, sostuvo el ex funcionario.

Las vistas continúan hoy con la comparecencia del 
superintendente de la Policía, Pedro Toledo. El 
secretario de Justicia, Roberto J. Sánchez Ramos, 
pidió ser excusado de la vista de ayer, pero se 
reunirá con los comisionados de la CDC el 4 de junio.

The ex director of the Institute of Forensic 
Sciences (IFS), Pío Rechany, assured yesterday 
that agents of the Federal Bureau of 
Investigations (FBI) shot at Filiberto Ojeda Ríos 
with the intention of killing the independentista leader.

“They were using excessive force to see if they 
could kill him through the door,” said Rechany 
during the first day of public hearings convened 
by the Civil Rights Commission (CRC) in its investigation of Ojeda Ríos’ death.

Rechany, who directed the IFS for 13 years, 
alluded to three shots in the ceiling of Ojeda 
Ríos’ house that went through a wooden door that 
was never open. He said this was a violation of 
the FBI’s  “use of deadly force manual,” because it was not in self defense.

The FBI has denied that it acted illegally in the 
death of Ojeda Ríos. The report of the Office of 
Inspector General (OIG), another federal organism, exonerates them.

Rechany commented that during the OIG’s 
investigation, he had to clarify various things 
for that agency. The first concerned the shots in 
the ceiling. The second concerned two bullets 
that did not reconcile with the weapons the FBI 
surrendered as those used in the shooting. The 
OIG said at the beginning that it was an error on 
the part of the IFS, but later a federal agent 
surrendered the weapon from which the shots were 
fired, saying that he hadn’t done so before 
because he didn’t remember having used it.

Rechany says “Brian” lied
The former chief of the IFS criticized the OIG’s 
conclusions. “The agents denied the bullets in 
the door, denied the two shells... which should 
completely rob them of credibility... (Luis) 
Fraticelli admitted that he lost control of the 
scene. How can you conclude that everything was ok?” Rechany posed.

He also speculated that “Brian,” the agent who 
fired the fatal shot, lied when he said he saw 
Ojeda Ríos, by the light of the refrigerator, at 
the moment he shot. He indicated that on the 
internet you can see that rifles like those used 
by the FBI come with technology such as infrared 
lights or heat detectors that would permit them 
to know exactly where to shoot. Rechany also 
believes that “Brian” followed a direct order to shoot to kill Ojeda Ríos.

Rechany believes that Ojeda Ríos could have been 
captured without deadly force at the scene they 
retrieved 107 shells from FBI rifles and 19 from 
Ojeda Ríos’ pistol on September 23, 2005 in Hormigueros.

“The operation was wrong,” maintained the ex functionary.

Hearings will continue today with the appearance 
of Police superintendent, Pedro Toledo. Attorney 
General Roberto J. Sánchez Ramos asked to be 
excused from yesterday’s hearing, but will meet 
with the CRC commissioners on June 4.
