El Colegio de Abogados acudió ayer a la 
Organización de las Naciones Unidas (ONU) para 
que investigue a Estados Unidos por la muerte de 
Filiberto Ojeda Ríos, a manos de agentes del 
Negociado Federal de Investigaciones (FBI).

La querella de 30 páginas recomienda que el 
relator especial sobre ejecuciones 
extrajudiciales de la ONU, el australiano Philip 
Alston, entreviste a 31 personas incluyendo al 
gobernador Aníbal Acevedo Vilá y a Luis 
Fraticelli, director en Puerto Rico del FBI.

“El Departamento de Justicia de Puerto Rico pudo 
radicar cargos criminales, incluyendo cargos 
contra el jefe del FBI en Puerto Rico, Luis 
Fraticelli. Nada se ha hecho sobre este crimen”, reza la querella.

Aparte del rol directo del FBI, agencia que ha 
defendido su actuación del 23 de septiembre de 
2005, la denuncia internacional critica la 
impunidad que promueven las cortes federales al 
impedir que el gobierno estatal investigue.

El documento cuestiona, además, la falta del 
debido proceso que implica que el juez José A. 
Fusté ordenara el allanamiento a la casa de 
Filiberto y a la misma vez desestimara la demanda del Gobierno de Puerto Rico.

“Lo que hizo el OIG (la Oficina del Inspector 
General) es insuficiente, fue como un informe 
casi de mandado”, expresó por su parte Celina 
Romany, presidenta del Colegio de Abogados.

Tras la radicación de la querella, el próximo 
paso es que Alston se comunique con el Gobierno 
de Estados Unidos. Una vez el gobierno federal 
avale que Alston venga a Puerto Rico, el relator 
de la ONU visitará la Isla para una pesquisa de 
campo relacionada a la muerte de Ojeda Ríos el 23 de septiembre de 2005.

Si Estados Unidos no avala la visita de Alston, 
el relator anotará la negativa en su informe y 
denunciará a nivel internacional la postura 
estadounidense, según Romany y los también 
licenciados Ricardo Alfonso García y Fermín 
Arraiza Navas, miembros de la tercera comisión 
del Colegio que interviene en este caso.

Los abogados plantean que el caso de Ojeda Ríos 
no ha sido la única ejecución extrajudicial en la 
Isla, al mencionar como ejemplo la muerte de 
Santiago Mari Pesquera, el hijo del líder independentista Juan Mari Brás.

The Bar Association yesterday resorted to the 
United Nations (U.N.), asking that it investigate 
the United States for the death of Filiberto 
Ojeda Ríos at the hands of agents of the Federal 
Bureau of Investigations (FBI).

The 30 page complaint recommends that the U.N. 
Special Rapporteur for Extrajudicial Executions, 
Australian Philip Alston, interview 31 people 
including governor Aníbal Acevedo Vilá and Luis 
Fraticelli, director of the FBI in Puerto Rico.

“The Puerto Rico Department of Justice could file 
criminal charges, including charges against the 
chief of the FBI in Puerto Rico, Luis Fraticelli. 
Nothing has been done about this crime,” the complaint alleges.

Apart from the direct role of the FBI, which has 
defended its conduct on September 23, 2005, the 
international denunciation criticizes the 
impunity encouraged by the federal courts in 
impeding the state government investigation.

The document questions, in addition, the lack of 
due process implicated when judge José A. Fusté 
ordered the search of Filiberto’s house and at 
the same time dismissed the lawsuit of the Government of Puerto Rico.

“What the OIG (Office of Inspector General) did 
is insufficient; it was almost a rubber stamp 
report,” expressed Celina Romany, president of the Bar Association.

The next step after filing the complaint is for 
Alston to communicate with the Government of the 
United States. Once the federal government 
approves Alston coming to Puerto Rico, the U.N. 
Rapporteur will visit the Island for a field 
investigation related to the death of Ojeda Ríos on September 23, 2005.

If the U.S. does not approve Alston’s visit, the 
Rapporteur will note the denial in his report and 
will denounce the U.S. position on an 
international level, according to Romany as well 
as attorneys Ricardo Alfonso García and Fermín 
Arraiza Navas, members of the third Bar 
Association commission to intervene in this case.

The attorneys posit that the case of Ojeda Ríos 
is not the only extrajudicial execution on the 
Island, mentioning as an example the death of 
Santiago Mari Pesquera, son of independentista leader Juan Mari Brás.
