government and its president Dina Boluarte remain in power despite the
deaths of protesters and planned mobilizations for the Third Takeover of
Lima.</em></p>
<p>As the Boluarte coup regime continues to dig its heels in six months
after the parliamentary coup by the Fujimori right-wing Congress ousted
democratically elected president Pedro Castillo, there has yet to be any
justice for the massacres, repression and other human rights abuses
during the uprising since December 7th. Despite multiple legal
challenges from inside the country and international investigations into
human rights abuses, Boluarte has stated as recently as last week that
she will <a href="https://larepublica.pe/politica/gobierno/2023/06/17/dina-boluarte-advierten-que-permanencia-hasta-el-2026-afectara-mas-a-la-democracia-congreso-adelanto-de-elecciones-defensoria-del-pueblo-1401225" rel="nofollow" class="gmail-0" target="_blank">continue her term through 2026<span class="gmail-0"><span class="element-invisible"> </span></span></a>.This
move has outraged Peruvians who have been mobilized and organized
against this dictatorship for six months and are building towards the <a href="https://www.exitosanoticias.pe/actualidad/tercera-toma-lima-cerca-13-mil-manifestantes-llegarian-puno-protestar-dina-boluarte-n101616" rel="nofollow" class="gmail-0" target="_blank">Tercera Toma de Lima<span class="gmail-0"><span class="element-invisible"> </span></span></a>
(Third Takeover of Lima) on July 19th, with Puno alone mobilizing
13,000 people towards the capital city, 1,000 from each of the thirteen
provinces within the department of Puno.</p>
<p>More than six months into this coup administration, none of the cases
brought forth either under the Public Ministry or Congress have
resulted in any justice for the victims of these massacres, let alone
the demand for Boluarte to step down. On December 29th, the first legal
case against Boluarte, several of her ministers, and top ranking police
and military officials was brought in <a href="https://elbuho.pe/2022/12/denuncian-a-boluarte-por-presuntos-delitos-de-genocidio-y-homicidio-calificado/" rel="nofollow" class="gmail-0" target="_blank">Ayacucho<span class="gmail-0"><span class="element-invisible"> </span></span></a> for genocide and qualified homicide that killed 8 on December 15th. Then in February in the region of <a href="https://peoplesdispatch.org/2023/02/16/peruvian-organizations-take-legal-action-against-dina-boluarte-over-killings-of-protesters/" rel="nofollow" class="gmail-0" target="_blank">Apurímac<span class="gmail-0"><span class="element-invisible"> </span></span></a>,
a group of human rights organizations and lawyers filed a legal
complaint over the six deaths during the first five days of the
demonstrations against Boluarte. And in early January, the <a href="https://www.bbc.com/mundo/noticias-america-latina-64232156" rel="nofollow" class="gmail-0" target="_blank">Peruvian Attorneys General office<span class="gmail-0"><span class="element-invisible"> </span></span></a>
opened a preliminary investigation against Dina Boluarte for genocide,
qualified homicide and serious injuries after the initial bloodshed in
the regions of Apurímac, La Libertad, Puno, Junín, Arequipa and Ayacucho
days before Congress member <a href="https://comunicaciones.congreso.gob.pe/damos-cuenta/presentan-denuncia-constitucional-contra-presidenta-dina-boluarte-y-expremier-pedro-angulo/" rel="nofollow" class="gmail-0" target="_blank">Sigrid Bazán<span class="gmail-0"><span class="element-invisible"> </span></span></a>
along with others in her coalition presented a constitutional complaint
against Boluarte and several Minsters, including Luis Otárola, now the
President of the Council of Ministers.</p>
<p>Not surprisingly, the <a href="https://andina.pe/agencia/noticia-congreso-declaran-improcedente-denuncia-constitucional-contra-presidenta-dina-boluarte-939063.aspx" rel="nofollow" class="gmail-0" target="_blank">Subcommittee on Constitutional Accusations of Congress <span class="gmail-0"><span class="element-invisible"> </span></span></a>declared
the constitutional case against Boluarte inadmissible on May 5th. In an
eleven to five vote, with three abstentions, to dismiss the case, the
right-wing controlled Congress declared the lives of those massacred as
merely a consequence of taking power and repressing the population. The
vote for a previous constitutional complaint filed by a different
congressmember failed with similar margins. Many doubt they’ll see
justice in the Public Ministry with the Attorney General Patricia
Benavides, who has been at the center of multiple controversies that
delegitimize her in the eyes of people mourning all these deaths, with
some even calling for her <a href="https://www.telam.com.ar/notas/202305/628327-renuncia-fiscal-general-peru.html" rel="nofollow" class="gmail-0" target="_blank">resignation<span class="gmail-0"><span class="element-invisible"> </span></span></a>. An <a href="https://elcomercio.pe/politica/dina-boluarte-en-vivo-congreso-vacancia-presidencial-por-muertes-en-protestas-votos-debate-video-en-directo-noticia/?ref=ecr" rel="nofollow" class="gmail-0" target="_blank">impeachment<span class="gmail-0"><span class="element-invisible"> </span></span></a> vote brought forth by members of Castillo’s former party Perú Libre against Boluarte also failed in April. </p>
<p>At her last summons in front of the Public Ministry on June 6th, <a href="https://larepublica.pe/politica/judiciales/2023/06/06/dina-boluarte-hoy-en-vivo-presidenta-declara-ante-la-fiscalia-por-muertes-en-protesta-514590" rel="nofollow" class="gmail-0" target="_blank">Boluarte<span class="gmail-0"><span class="element-invisible"> </span></span></a>
did not respond to questioning for the deaths of 49 people in the first
months of the uprising, with her lawyer saying she would not be giving
up her right to remain silent. In April her lawyer, <a href="https://canaln.pe/actualidad/abogado-dina-boluarte-sobre-muertes-manifestaciones-ninguna-manera-puede-calificado-genocidio-n460384" rel="nofollow" class="gmail-0" target="_blank">Joseph Campos<span class="gmail-0"><span class="element-invisible"> </span></span></a>, had denied that there was any massacre during an interview with Canal N and in June stated that the more than 60 deaths were <a href="https://actualidad.rt.com/actualidad/469533-defensa-boluarte-orden-masacrar-100-muertos" rel="nofollow" class="gmail-0" target="_blank">isolated cases<span class="gmail-0"><span class="element-invisible"> </span></span></a>
and that if there had been an executive order to the military and
police commanders to massacre the protesters, they would be "talking
about 10, 15, 20 or 100 deaths a day, at least.” Meanwhile <a href="https://www.aap.com.pe/articulos/rn9XGWxa3sJjyV7Z8U5DXq0eDWIEANg1" rel="nofollow" class="gmail-0" target="_blank">Aeropuertos Andinos del Perú<span class="gmail-0"><span class="element-invisible"> </span></span></a>, the operator of several airports in Perú, including in Ayacucho and Juliaca where two of the massacres took place, has <a href="https://www.youtube.com/watch?v=UwCoGHebLYk" rel="nofollow" class="gmail-0" target="_blank">deleted footage<span class="gmail-0"><span class="element-invisible"> </span></span></a> from those days, likely at the behest of the coup regime.</p>
<p>The fight for justice in the courts seem to be held up but the people
of Perú continue to wage their struggle in the streets and in their
communities in popular assemblies to overturn this violation of their
political rights as they see the coup not just against president Pedro
Castillo but against the popular will that saw the first indigenous
president of humble origins take state power for the benefit of the poor
masses. During festivities for Inti Raymi, the celebrations during the
month of June in honor of Inti, the Incan sun god, students and artists
from various provinces and regions in <a href="https://twitter.com/ctlsabancay/status/1670493735476514816?s=12" rel="nofollow" class="gmail-0" target="_blank">Cusco<span class="gmail-0"><span class="element-invisible"> </span></span></a>
and elsewhere in the south marched with sculptures against the Boluarte
dictatorship showing her as a rat and standing on the skulls of the
more than 80 martyrs during these past six months of uprising.</p>
<p>In an interview with news outlet Exitosa, Raúl Ariste, the Secretary
General of the Comando Unitario de Lucha of Junin, said Boluarte staying
until 2026 was a <a href="https://www.exitosanoticias.pe/politica/comando-unitario-lucha-junin-sobre-adelanto-elecciones-lo-ha-hecho-dina-boluarte-declararnos-guerra-n101457" rel="nofollow" class="gmail-0" target="_blank">declaration of war<span class="gmail-0"><span class="element-invisible"> </span></span></a>.
"What the president does is practically declare war on a people whose
only weapons are the streets, squares and parks, while the president has
the Army and the National Police, on top of that there are US soldiers
who are arriving." He said no amount of tanks or bullets would stop the
popular struggle to oust Boluarte, for a new constitution and to
reinstate Pedro Castillo to end the political crisis that has rocked the
country for half a year. For Roger Cruz, the coordinator of the <a href="https://www.cutivalu.pe/poblacion-de-puno-ratifica-la-tercera-toma-de-lima-tras-declaraciones-de-presidenta/" rel="nofollow" class="gmail-0" target="_blank">Committee of Struggle in Azangaro, Puno<span class="gmail-0"><span class="element-invisible"> </span></span></a>,
“we are ready to continue fighting and to achieve our political
objectives: the resignation and closure of Congress and new elections.
It is a political solution for the people and let's go to the progress
and development of the Peruvian population”. The department of Puno has
said they will be sending 13,000 people to the capital city in mid July
while other regions have also declared their participation in the next
takeover of Lima, like <a href="https://www.cutivalu.pe/piura-se-sumara-a-puno-y-otras-regiones-para-la-tercera-toma-de-lima/" rel="nofollow" class="gmail-0" target="_blank">Piura<span class="gmail-0"><span class="element-invisible"> </span></span></a>
where on July 1st and 2nd, there will be a macroregional encounter in
Jaėn, to establish strategies and plan of action. Whether the Boluarte
regime steps down as a result of legal cases or resigns as a result of
the mass mobilizations, Peruvians are adamant this regime will fall one
way or another.</p>

<p>"Me quedo hasta el 2026": Boluarte rechaza elecciones adelantadas mientras Perú se prepara para la tercera toma de Lima</p>
<p>Mientras el régimen golpista de Boluarte sigue en el poder seis meses
después de que el golpe parlamentario de la derecha fujimorista derrocó
al presidente democráticamente elegido Pedro Castillo, aún no se ha
hecho justicia por las masacres, la represión y otros crímenes de lesa
humanidad cometidos durante la revuelta desde el 7 de diciembre. A pesar
de los múltiples desafíos legales interpuestos en el país y de las
investigaciones internacionales sobre violaciones de los derechos
humanos, Boluarte declaró la semana pasada que <a href="https://larepublica.pe/politica/gobierno/2023/06/17/dina-boluarte-advierten-que-permanencia-hasta-el-2026-afectara-mas-a-la-democracia-congreso-adelanto-de-elecciones-defensoria-del-pueblo-1401225" rel="nofollow" class="gmail-0" target="_blank">continuará en el cargo hasta 2026<span class="gmail-0"><span class="element-invisible"> </span></span></a>,
lo que ha indignado a los peruanos, que llevan seis meses movilizados y
organizados contra esta dictadura y se preparan para la <a href="https://www.exitosanoticias.pe/actualidad/tercera-toma-lima-cerca-13-mil-manifestantes-llegarian-puno-protestar-dina-boluarte-n101616" rel="nofollow" class="gmail-0" target="_blank">Tercera Toma de Lima<span class="gmail-0"><span class="element-invisible"> </span></span></a>,
el 19 de julio. Sólo en Puno se van movilizar 13.000 personas hacia la
capital, 1.000 de cada una de las trece provincias del departamento de
Puno.</p>
<p>Más de seis meses después de esta administración golpista, ninguno de
los casos presentados ni en el Ministerio Público ni en el Congreso ha
resultado en justicia para las víctimas de estas masacres, y mucho menos
en la demanda de la renuncia de Boluarte. El 29 de diciembre se
presentó en <a href="https://elbuho.pe/2022/12/denuncian-a-boluarte-por-presuntos-delitos-de-genocidio-y-homicidio-calificado/" rel="nofollow" class="gmail-0" target="_blank">Ayacucho<span class="gmail-0"><span class="element-invisible"> </span></span></a>
la primer caso legal contra Boluarte, varios de sus ministros y altos
mandos policiales y militares por genocidio y homicidio calificado que
dejó 8 muertos el 15 de diciembre. Luego, en febrero en la región de <a href="https://peoplesdispatch.org/2023/02/16/peruvian-organizations-take-legal-action-against-dina-boluarte-over-killings-of-protesters/" rel="nofollow" class="gmail-0" target="_blank">Apurímac<span class="gmail-0"><span class="element-invisible"> </span></span></a>,
un grupo de organizaciones de derechos humanos y abogados presentaron
una denuncia legal por las seis muertes durante los primeros cinco días
de las manifestaciones contra Boluarte. A principios de enero, la <a href="https://www.bbc.com/mundo/noticias-america-latina-64232156" rel="nofollow" class="gmail-0" target="_blank">Fiscalía de la Nación<span class="gmail-0"><span class="element-invisible"> </span></span></a>
abrió una investigación preliminar contra Dina Boluarte por genocidio,
homicidio calificado y lesiones graves tras el derramamiento de sangre
inicial en las regiones de Apurímac, La Libertad, Puno, Junín, Arequipa y
Ayacucho días antes de que la congresista <a href="https://comunicaciones.congreso.gob.pe/damos-cuenta/presentan-denuncia-constitucional-contra-presidenta-dina-boluarte-y-expremier-pedro-angulo/" rel="nofollow" class="gmail-0" target="_blank">Sigrid Bazán<span class="gmail-0"><span class="element-invisible"> </span></span></a>
junto con otros en su coalición presentó una demanda constitucional
contra Boluarte y varios ministros, incluido Luis Otárola, ahora
presidente del Consejo de Ministros.</p>

declaró inadmisible el caso constitucional contra Boluarte el 5 de
mayo. En una votación de once a cinco, con tres abstenciones, para
desestimar el caso, el Congreso controlado por la derecha declaró que
las vidas de los masacrados eran una mera consecuencia de la toma del
poder y de la represión de la población. La votación de un recurso de
inconstitucionalidad anterior presentado por otro congresista fracasó
con márgenes similares. Muchos dudan que vean justicia en el Ministerio
Público con la Fiscal General Patricia Benavides, quien ha estado en el
centro de múltiples controversias que la deslegitima ante el pueblo
todavía en luto, con algunos incluso <a href="https://www.telam.com.ar/notas/202305/628327-renuncia-fiscal-general-peru.html" rel="nofollow" class="gmail-0" target="_blank">pidiendo su renuncia<span class="gmail-0"><span class="element-invisible"> </span></span></a>. En abril también fracasó una <a href="https://elcomercio.pe/politica/dina-boluarte-en-vivo-congreso-vacancia-presidencial-por-muertes-en-protestas-votos-debate-video-en-directo-noticia/?ref=ecr" rel="nofollow" class="gmail-0" target="_blank">moción de vacancia<span class="gmail-0"><span class="element-invisible"> </span></span></a> presentada por miembros del partido de Castillo, Perú Libre, contra Boluarte.</p>
<p>En su última citación ante el Ministerio Público el 6 de junio, <a href="https://larepublica.pe/politica/judiciales/2023/06/06/dina-boluarte-hoy-en-vivo-presidenta-declara-ante-la-fiscalia-por-muertes-en-protesta-514590" rel="nofollow" class="gmail-0" target="_blank">Boluarte<span class="gmail-0"><span class="element-invisible"> </span></span></a>
no respondió al interrogatorio por las muertes de 49 personas en los
primeros meses de la protesta, y su abogado afirmó que no renunciaría a
su derecho a guardar silencio. En abril, su abogado, <a href="https://canaln.pe/actualidad/abogado-dina-boluarte-sobre-muertes-manifestaciones-ninguna-manera-puede-calificado-genocidio-n460384" rel="nofollow" class="gmail-0" target="_blank">Joseph Campos<span class="gmail-0"><span class="element-invisible"> </span></span></a>,
negó que hubiera ocurrido alguna masacre durante una entrevista con
Canal N, y en junio afirmó que las más de 60 muertes fueron <a href="https://actualidad.rt.com/actualidad/469533-defensa-boluarte-orden-masacrar-100-muertos" rel="nofollow" class="gmail-0" target="_blank">casos aislados<span class="gmail-0"><span class="element-invisible"> </span></span></a>
y que si hubiera existido una orden ejecutiva a los comandantes
militares y policiales de masacrar a los manifestantes, estaríamos
"hablando de 10, 15, 20 o 100 muertes al día, al menos". Mientras tanto,
<a href="https://www.aap.com.pe/articulos/rn9XGWxa3sJjyV7Z8U5DXq0eDWIEANg1" rel="nofollow" class="gmail-0" target="_blank">Aeropuertos Andinos del Perú<span class="gmail-0"><span class="element-invisible"> </span></span></a>, el operador de varios aeropuertos en Perú, incluidos los de Ayacucho y Juliaca, donde ocurrieron dos de las masacres, ha <a href="https://www.youtube.com/watch?v=UwCoGHebLYk" rel="nofollow" class="gmail-0" target="_blank">borrado el registro<span class="gmail-0"><span class="element-invisible"> </span></span></a> de videocámaras de aquellos días, presumiblemente por orden del régimen de golpe de estado.</p>
<p>La lucha por la justicia en los tribunales parece estar estancada,
pero el pueblo de Perú continúa en pie de lucha en las calles y en sus
comunidades, en asambleas populares, para revertir esta violación de sus
derechos políticos. Ven el golpe no solo contra el presidente Pedro
Castillo, sino contra la voluntad popular que llevó al poder al primer
presidente indígena de origen humilde en beneficio de las masas pobres.
Durante las festividades del Inti Raymi, las celebraciones del mes de
junio en honor de Inti, el dios inca del sol, estudiantes y artistas de
varias provincias y regiones de <a href="https://twitter.com/ctlsabancay/status/1670493735476514816?s=12" rel="nofollow" class="gmail-0" target="_blank">Cusco<span class="gmail-0"><span class="element-invisible"> </span></span></a>
y otras partes del sur marcharon con esculturas en contra de la
dictadura de Boluarte, mostrándola como una rata y de pie sobre los
cráneos de los más de 80 mártires durante estos últimos seis meses de
levantamiento.</p>
<p>En una entrevista con el medio Exitosa, Raúl Ariste, secretario
general del Comando Unitario de Lucha de Junín, dijo que la permanencia
de Boluarte hasta 2026 es <a href="https://www.exitosanoticias.pe/politica/comando-unitario-lucha-junin-sobre-adelanto-elecciones-lo-ha-hecho-dina-boluarte-declararnos-guerra-n101457" rel="nofollow" class="gmail-0" target="_blank">una declaración de guerra<span class="gmail-0"><span class="element-invisible"> </span></span></a>
para el pueblo. "Lo que hace la presidenta es prácticamente declararle
la guerra a un pueblo cuyas únicas armas son las calles, las plazas y
los parques, mientras la presidenta tiene al Ejército y a la Policía
Nacional, encima están llegando soldados norteamericanos". Dijo que
ningún tanque o bala detendría la lucha popular por la salida de
Boluarte, por una nueva Constitución y por la restitución de Pedro
Castillo para poner fin a la crisis política que sacude al país desde
hace medio año. Para Roger Cruz, coordinador del <a href="https://www.cutivalu.pe/poblacion-de-puno-ratifica-la-tercera-toma-de-lima-tras-declaraciones-de-presidenta/" rel="nofollow" class="gmail-0" target="_blank">Comité de Lucha en Azángaro, Puno<span class="gmail-0"><span class="element-invisible"> </span></span></a>,
“estamos dispuestos a seguir luchando y lograr nuestros objetivos
políticos: la renuncia y cierre del Congreso y nuevas elecciones. Es una
solución política para el pueblo y vamos al progreso y desarrollo de la
población peruana". El departamento de Puno ha dicho que enviará 13.000
personas a la capital a mediados de julio, mientras que otras regiones
también han declarado su participación en la próxima toma de Lima, como <a href="https://www.cutivalu.pe/piura-se-sumara-a-puno-y-otras-regiones-para-la-tercera-toma-de-lima/" rel="nofollow" class="gmail-0" target="_blank">Piura<span class="gmail-0"><span class="element-invisible"> </span></span></a>,
donde el 1 y 2 de julio se realizar un encuentro macro regional en
Jaėn, para establecer estrategias y plan de acción. Ya sea que el
régimen de Boluarte caiga como resultado de los casos legales o renuncie
como resultado de las movilizaciones masivas, los peruanos están firmes
en que este régimen caerá de una u otra manera.</p>
